Sithemba ukuthi ushintsho emthethweni wokuqasha uzokwenza umehluko, kuloba uNtokozo Biyela

NGESONTO elidlule uMengameli uMnu uCyril Ramaphosa usayine ukuchibiyela umthetho okhuthaza ukuthi kunikwe bonke abantu amathuba uma kuqashwa i-Employment Equity Amendment Bill of 2020.

Uchitshiyelwe ngoba kade kubuyekezwa umthetho owawushayiwe i-Employment Equity Act of 1998 (isigaba 55). Umthetho omusha usunika uNgqongqoshe wokuQasha nemiSebenzi amandla okuthi kube nguye obekela izimboni ukuthi kufanele zifinyelele kuphi ukuletha ushintsho ngoba kubonakala ukuthi kukhona lapho kugqoza khona. 

Izinkampani eziqashe abantu abawu-50 kuya phezulu kufanele zisho ukuthi yiziphi izinhlelo ezinazo zokuletha ushintsho futhi zisho ukuthi zizokwenza kanjani loku. 

Kufanele zithumele umbiko kanye ngonyaka emNyangweni wokuQasha nemiSebenzi. Izinkampani ezifisa ukuthola umsebenzi kuhulumeni kuzofanele zibe nesitifiketi salo mnyango esifakazayo ukuthi ziyawuhlonipha lo mthetho. 

Siyazi ke sonke ukuthi sisuka kuphi siyiNingizimu Afrika. Sisuka lapho abelungu bazisikela kwelinonile emisebenzini yekhethelo. Yibona ababephatha izikhundla emsebenzini kuzo zonke izimboni. Abelungu abasahola kangcono ukudlula zonke ezinye izinhlanga, kulandele amaNdiya bese kuza ezinye izizwe kodwa abantu abamnyama kuze kube manje, basahola amakinati. 

Iningi labantu abamnyama noma lifunde kangakanani kodwa namanje linqabile ezikhundleni eziphezulu ngoba kuzona kusagcwele abelungu. Kuthiwa wu-3% kuphela ophethwe ngabantu abamnyama. Akulungile loku futhi kuyamangaza ngoba ezweni lonke nje lingaka, thina singabantu abamnyama siwu-80% kodwa uma kukhulunywa ngokuphatha izikhundla emsebenzini sivalelwa ngaphandle.

Noma ngabe imiphi imizamo uhulumeni akade eyizama ukuphoqa izinkampani ukuthi ziqashe abantu ngokulingana, izinkampani eziningi bezingayingeni eyalezo zinguquko.

Umthetho omusha usho ukuthi izinguquko zizogadwa abahloli abathile bomNyango wokuQasha nemiSebenzi. Njalo nje uma kuphela izinyanga eziyisithupha abahloli bazohlola ukuthi izinhlelo izinkampni ezizibhale phansi ziyazilandela yini. 

Loku kusho ukuthi abazukubheka nje kuphela ukuthi yini ebhalwe phansi kodwa bazohamba bevakashele izinkampani ukuyohlola ukuthi kuyenzeka yini nasemsebenzini njengokusho kwazo emaphepheni. Uma kungenzeki, lezo zinkampani noma izimboni zizohlawuliswa.

Kusho ukuthini loku na? Loku kusho ukuthi manje sekuzokwenzeka ukuthi umthetho nemigomo ihluke ngezinkampani, ngisho izimboni zifana. Kuzoya ngokuthi lezi zimboni zikusiphi isifundazwe. 

Izinkampani eziningi zizithola zisenkingeni yokuhambisana nale migomo yoguquko nokuqasha emsebenzini ngoba zisafuna ukudla ngoludala. Izinkampani eziningi aziziboni ziphethwe ngabantu abamnyama. Kusewumzabalazo omkhulu ukwamukela kwabanye ukuthi kunabantu abamnyama abafunde kakhulu futhi banamava okuphatha izinkampani abasebenza kuzona ngokufanayo noma ngaphezulu ukwedlula inqwaba yabelungu.
